If you look at the comments, people are saying Brittanya was off the wall drunk at the party and left with the two promoters, Ty and Dusty. Ty took the picture. But she is still talking to them both on twitter.

If you go through the tweets, she basically tweeted back and forth with them the next day, saying she was hungover etc. The only person who made a mention of rape was the vh1 promoter who e-mailed the dirty to get them to take the pic down.

me too...rape is a strong accustation to be putting out there, and there are a lot of rape victums who are afraid to seek justice for fear of not being believed do to people misusing to word rape to suit their hidden agenda

She's still talking to her alleged rapist on twitter and answering questions about the pic. I think the guy who wrote the e-mail about the rape just thought it would get them to take the pic down, and instead it backfired and they published the letter.

If she was passed out it was still rape, she might just be trying to stay strong about the whol thing, but if you're passed out and someone has sex with you, it's rape.
